By accessing the Website, creating an account, subscribing, or placing an order, you agree to be bound by these Terms.

By subscribing, you agree that:

  • you will receive wine deliveries at the selected frequency (typically monthly)

  • your subscription will renew automatically unless cancelled in accordance with these Terms

  • payment will be processed automatically in advance of each scheduled dispatch

Subscription products may include mixed 6-packs or 12-packs and may vary from month to month depending on availability and curation.

6. Orders and Acceptance

When you place an order or subscribe, you are making an offer to purchase products from us.

We reserve the right to accept or reject any order at our discretion, including where:

  • we cannot verify your age

  • there is an error in pricing or product description

  • stock is unavailable

  • delivery restrictions apply

  • we suspect fraud or misuse

An order is not confirmed until you receive an order confirmation email.

7. Products and Availability

All products sold by Killa Plonk are supplied as sealed packaged liquor (wine).

Availability may change without notice. If a product becomes unavailable, we may substitute a similar product of equal or greater value or offer a refund at our discretion.

8. Pricing and Payment

9. Delivery and Dispatch

9.1 Dispatch Timing

Killa Plonk typically dispatches subscription orders during the second week of each month.

New subscriber orders may be dispatched within two business days where possible.

Dispatch times are estimates only and may vary due to courier availability, public holidays, weather, or other factors outside our control.

9.2 Delivery Partners

Deliveries are completed through third-party courier services including (but not limited to):

  • Australia Post

  • Aramex Australia Courier Service

Once an order has been lodged with the courier, delivery timeframes are managed by the courier.

9.3 Delivery Address Requirements

You must provide a valid delivery address within Australia (unless otherwise stated on the Website).

We do not guarantee delivery to PO Boxes, parcel lockers, or locations where signature verification cannot occur.

9.4 Signature Required / No Authority to Leave

Alcohol deliveries must be received by a person aged 18 or over.

You acknowledge and agree that:

  • deliveries will not be left unattended

  • you must ensure a person aged 18+ is present to accept delivery

  • couriers may require a signature and/or proof of age

9.5 Identification Checks

The courier may request valid photo identification to confirm age. Acceptable ID includes:

  • Australian driver licence

  • Australian proof of age card

  • passport

If ID is not provided or age cannot be verified, delivery will be refused.

9.6 Refusal of Delivery

Delivery may be refused if the courier reasonably believes:

  • the recipient is under 18

  • the recipient is intoxicated

  • the address is unsafe

  • no suitable recipient is available

If delivery is refused, the parcel will be returned to the courier depot or returned to sender in accordance with courier procedures.

10. Failed Deliveries and Re-Delivery

If delivery cannot be completed due to no eligible recipient being available, the courier may:

  • attempt re-delivery

  • hold the parcel at a depot for collection (subject to courier policy)

  • return the parcel to sender

You are responsible for ensuring someone aged 18+ is available to accept delivery.

If an order is returned to us due to failed delivery, we may charge a re-delivery fee.

11. No Customer Pick-Up / No Public Access

Killa Plonk operates from a residential premises used for storage and packing only.

Customers are not permitted to attend the premises at any time.

We do not allow customer pick-up, click-and-collect, tastings, or on-site sales.

Any attempt to attend the premises may result in immediate cancellation of your account and refusal of service.

12. Responsible Service and Responsible Consumption

Killa Plonk supports the responsible enjoyment of alcohol.

We do not promote excessive consumption or irresponsible drinking.

We reserve the right to refuse service to any customer where we reasonably believe the purchase or supply may contribute to alcohol-related harm or breach legal requirements.

13. Promotions and Marketing

Promotional offers may be available from time to time. All promotions are subject to availability and may be withdrawn at any time.

Killa Plonk does not offer promotions intended to encourage rapid or excessive consumption, including bulk “drink more” incentives.

Any merchandise offered as part of promotions (e.g., tote bags, t-shirts) is subject to stock availability.

14. Cancellations and Subscription Changes

You may cancel your subscription at any time through your account settings or by contacting us.

Cancellations must be made before the monthly cut-off date displayed on the Website (or otherwise communicated) to prevent billing and dispatch for the next cycle.

If a subscription has already been billed and dispatched, cancellation will apply to future cycles only.

15. Returns and Refunds

15.1 Change of Mind

Due to the nature of alcohol products, we do not offer refunds for change of mind, including where you decide you no longer want the product after dispatch.

15.2 Faulty or Damaged Goods

If your product arrives damaged, faulty, or not as described, you may be entitled to a replacement or refund under the Australian Consumer Law.

You must notify us within a reasonable timeframe and provide evidence (such as photographs).

15.3 Failed Delivery Due to Age or Intoxication

If delivery is refused because the recipient:

  • is under 18

  • cannot provide valid ID

  • appears intoxicated

You will not be entitled to an automatic refund.

We may offer a re-delivery option at our discretion, subject to additional delivery fees.

16. Risk, Title and Ownership

Ownership of goods passes to you once payment has been received and goods are dispatched.

Risk in delivery transfers to you upon dispatch, except where Australian Consumer Law requires otherwise.

17. Limitation of Liability

To the maximum extent permitted by law, Killa Plonk is not liable for:

  • indirect or consequential losses

  • delivery delays caused by courier services

  • loss resulting from failure to provide correct delivery information

  • refusal of delivery where legal or safety requirements apply

Nothing in these Terms excludes or limits rights you may have under the Australian Consumer Law.
